منشور حقوق بشر كورش بزرگ

دعاي كوروش در حق سرزمين ايران : اهورا مزدا ، اين سرزمين را ، اين مرز و بوم را ، از كينه ، از دشمن ، از دروغ ، از خشكسالي حفظ كند .

در همايش سيزدهمين اجلاس سراسري اعضاء هيئت مديره هاي كانون هاي سراسر كشور ، پائيز ۱۳۸۲ ، از طرف كانون محترم اصفهان ، ماكت كتيبه لوح منشور آزادي ( حقوق ) بشر ، پادشاه باستاني ايران ، به همراه صفحاتي از ترجمه لوح ، تقديم حضار گرديد . كه به جهت اهميت موضوع ، ذيلا تقديم مي گردد .

هر چند در روايات و معلومات اسلامي ، به نقل برخي از مفسرين ، مراد « از ذو القرنين » در قرآن مجيد ، به احتمالي ، شخص كوروش بوده است . لكن بدون شك ، نامبرده ، بزرگترين و برترين اعلاميه حقوق بشر دوران باستان را اعلام و اجرا كرده است .

در خصوص ترجمه عبارت متن كتبيه كوروش ، در كتاب « سرزمين جاويد » ،
تاليف ، ماژيران موله – هرتزفلد – گيرشمن ،

نويسندگان در اين كتاب ، اذعان دارند كه ، منشور آزادي كوروش ( در حدود ۲۵۴۳ سال قبل ) به مراتب از اعلاميه حقوق بشر انقلابيون فرانسه در قرن ۱۷ ميلادي و اعلاميه حقوق بشر قرن ۲۰ ميلادي سازمان ملل متحد ، برتر و معنويت بيشتري دارد .

منشور و اعلاميه كوروش ، در سال ۵۳۹ قبل از ميلاد ، بعد از تسخير و فتح شهر بابل صادر شده است . كوروش بعد از خاتمه زمستان در اولين روز بهار ، در بابل تاجگذاري كرد . شرح كامل تاج گذاري كوروش و حوادث آن دوران ، به صورت مفصل توسط « گزنفون » سردار و مرد جنگي و فيلسوف و مورخ يوناني ضبط و بيان شده است .

كوروش بعد از تاجگذاري ، در معبد مردوك خداي بزرگ بابل ، منشور آزادي نوع بشر را قرائت نمود .
متن سخنراني و كتبيه كوروش تا اين اواخر نامعلوم بود . تا اينكه اكتشافات در بين النهرين از ويرانه قديم شهر « اور » كتبيه اي بدست آمد و بعد از ترجمه معلوم شد ، همان متن منشور آزادي نوع بشر ، كوروش ميباشد .
اين كتيبه سنگي اينك در كتابخانه ملي انگلستان نگهداري ميشود ،
بدون ترديد ، از قديمترين و مهمترين اسناد حقوق بشر ، در تاريخ باستان مي باشد .

در اين كتبيه كوروش خود را معرفي نموده و اسم پدر ، جد اول ، دوم و سوم خويش را نام مي برد و اعلام مي دارد كه پادشاه ايران و پادشاه بابل و پادشاه جهات اربعه ( كشورهاي اطراف ايران ) مي باشد ، آنگاه در مقام بيان حقوق بشر و منشور آزادي خويش اعلام مي دارد :

ترجمه عين كتبيه :
اينك كه به ياري مزدا ، تاج سلطنت ايران و بابل و كشورهاي جهات اربعه را به سر گذاشته ام ، اعلام مي كنم كه تا روزي كه من زنده هستم و مزدا توفيق سلطنت را به من مي دهد ، دين و آيين و رسوم ملتهايي كه من پادشاه آنها هستم ، محترم خواهم شمرد و نخواهم گذاشت كه حكام و زير دستان من ، دين و آئين و رسوم ملتهايي كه من پادشاه آنها هستم يا ملتهاي ديگر را مورد تحقير قرار بدهند يا به آنها توهين نمايند .

من از امروز كه تاج سلطنت را به سر نهاده ام ، تا روزي كه زنده هستم و مزدا توفيق سلطنت را به من مي دهد ، هر گز سلطنت خود را بر هيچ ملت تحميل نخواهم كرد و هر ملت آزاد است ، كه مرا به سلطنت خود قبول كند يا ننمايد و هر گاه نخواهد مرا پادشاه خود بداند ، من براي سلطنت آن ملت مبادرت به جنگ نخواهم كرد .

من تا روزي كه پادشاه ايران و بابل و كشورهاي جهات اربعه هستم ، نخواهم گذاشت ، كسي به ديگري ظلم كند و اگر شخصي مظلوم واقع شد ، من حق وي را از ظالم خواهم گرفت و به او خواهم داد و ستمگر را مجازات خواهم كرد .

من تا روزي كه پادشاه هستم ، نخواهم گذاشت مال غير منقول يا منقول ديگري را به زور يا به نحو ديگر بدون پرداخت بهاي آن و جلب رضايت صاحب مال ، تصرف نمايد

من تا روزي كه زنده هستم ، نخواهم گذاشت كه شخصي ، ديگري را به بيگاري بگيرد و بدون پرداخت مزد ، وي را بكار وادارد .

من امروز اعلام مي كنم ، كه هر كس آزاد است ، كه هر ديني را كه ميل دارد ، بپرستد و در هر نقطه كه ميل دارد سكونت كند ، مشروط بر اينكه در آنجا حق كسي را غضب ننمايد ، و هر شغلي را كه ميل دارد ، پيش بگيرد و مال خود را به هر نحو كه مايل است ، به مصرف برساند ، مشروط به اينكه لطمه به حقوق ديگران نزند .

من اعلام مي كنم ، كه هر كس مسئول اعمال خود مي باشد و هيچ كس را نبايد به مناسبت تقصيري كه يكي از خويشاوندانش كرده ، مجازات كرد ، مجازات برادر گناهكار و برعكس به كلي ممنوع است
و اگر يك فرد از خانواده يا طايفه اي مرتكب تقصير ميشود ، فقط مقصر بايد مجازات گردد ، نه ديگران

من تا روزي كه به ياري مزدا ، سلطنت مي كنم ، نخواهم گذاشت كه مردان و زنان را بعنوان غلام و كنيز بفروشند و حكام و زير دستان من ، مكلف هستند ، كه در حوزه حكومت و ماموريت خود ، مانع از فروش و خريد مردان و زنان بعنوان غلام و كنيز بشوند و رسم بردگي بايد به كلي از جهان برافتد .

و از مزدا خواهانم ، كه مرا در راه اجراي تعهداتي كه نسبت به ملتهاي ايران و بابل و ملتهاي ممالك اربعه عهده گرفته ام ، موفق گرداند .

Human rights Charter of Cyrus , the Great Ancient King of Iran

The Human Rights Charter of Cyrus, the great ancient king of Iran was issued in 539 B.C. following the conquest of Babylonia. It was declared by Cyrus on the first day of spring when his coronation took place in Babylonia. After his coronation he went to Mardouk Temple of the great god and declared the Charter  

According to some experts specialized in Islamic knowledge Zolgharnain named in the holy Quran is probably the same as Cyrus. Needless to say, however, that Cyrus has issued and enforced the best and greatest declaration of human rights in the early history of the world. Yet, it should be recalled that Mazhiran Mole, Hertsfield and girshman state in their book, Eternal Land that the Cyrus Declaration issued about 2543 years ago is much better than human rights declaration of the French Revolution of the 17th century and the United Nations Declaration of the 20th Century

The text of Cyrus declaration was not known until recent excavation made in Mesopotamia under the old ruins of the city of Oor where an epigraph was discovered and after it was translated it was found to be the human rights charter of Cyrus. This inscription which is the oldest and the most important document of the human rights in the ancient history, is now kept in the British National Library. In that declaration, Syrus first introduces himself and then, as the king of Iran, Babylonia and the four cardinal countries pronounces the charter of the human rights

Text of the Charter of Human Rights of Cyrus
Now that with the grace of Mazda I am crowned for the kingdom of Iran, Babylonia and the four cardinal countries, I declare that 

As long as I am alive and favored by Mazda for the kingdom of Iran, Babylonia and the four cardinal countries, I undertake to honor the religion and custom of all nations under my kingdom. Thus, no governor or other subordinates under my realm shall be allowed to humiliate or insult the religion or custom of the nations under my kingdom or of other nations

From now, that I am crowned, until I am alive and blessed by Mazda for this kingdom, I shall never impose my kingdom to any nation, since the people are free to accept or be no war against them

As long as I am the king of Iran, Babylonia and the four cardinal countries, I shall not allow any one to oppress another. So, if anybody‘s right is injured, I shall take it from the oppressor and punish him and shall give it back to the oppressed

As long as I live, I shall not allow anyone to dispossess others‘ property by force or take it without consideration or satisfaction of the owner.

As long as I live, I shall not allow anyone to use forced or unpaid labor

Today I announce that everybody is free to choose any religion he believes in, and live any where he desires, provided he does not arrogate others‘ rights, and take any occupation he likes, and spend his property in any way he decides, providing he does not harm others‘ rights

I declare that every person is responsible for himself, and that no one shall be punished for actions committed by his relatives. Thus, punishment of the criminal‘s brother is forbidden. If a member of a family or tribe committed a crime, the person to be punished should be only the criminal, not others

So long as, with the grace of Mazda, I rule as the king, I shall not allow any man or woman to be sold as a slave. In this regard, my governors and other subordinates shall be responsible, in the sphere of their influence, to prevent the trade of slavery. This custom should be totally abolished throughout the world

And, I beg Mazda to succeed me in performing the obligations I have taken towards the nations of Iran, Babylonia and the nations of the four cardinal countries
